BOOKING TERMS AND CONDITIONS

By booking or participating in a Soccer Retreat and any related products or services (a “Soccer Retreat”) with BGCJ LLC, a Utah, USA company (“Soccer Retreats” or the “Tour Operator”), you (“you”) agree to these Terms & Conditions (the “Terms”).

By booking a Soccer Retreat, you acknowledge that you have read, understand and agree to be bound by these Terms. If you make a booking on behalf of other participants, you represent and warrant that you have the authority to accept these Terms on behalf of all participants in your party.

THE BOOKING CONTRACT

Your booking is confirmed and a contract exists when the Tour Operator issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to the Tour Operator or authorized agent immediately. Please ensure that names are exactly as stated in the relevant passport.

You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to the Tour Operator.

SPECIAL REQUIREMENTS

Any special requirements must be disclosed to the Tour Operator at the time of booking. The Tour Operator will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary.

Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to the Tour Operator at the time of booking, but the Tour Operator cannot guarantee that dietary needs or restrictions can be accommodated.

Any special requests or requirements do not form part of these Terms or the contract between you and the Tour Operator, and the Tour Operator is not liable for any failure to accommodate or fulfill such requests.

AGE REQUIREMENTS

Soccer Retreats are designed as family experiences, combining soccer training and activities for young players with leisure and vacation experiences for parents and other family members.

There is no minimum age requirement for children participating in a Soccer Retreat unless otherwise specifically stated for a particular activity or Soccer Retreat.

Anyone under the age of 18 is considered a minor. Minors must be accompanied by a parent, legal guardian, or other responsible adult throughout the Soccer Retreat. The accompanying adult is responsible for the supervision, safety, behavior and wellbeing of the minor(s) in their care.

The Tour Operator may establish specific age, height, skill, supervision or participation requirements for individual activities where required by the activity provider, resort, venue, local law or safety considerations. Such requirements will be communicated to participants where applicable.

If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all required consents, documentation and approvals and for ensuring that they and the minor(s) meet all legal requirements to travel to, enter and depart from applicable countries and regions.

The Tour Operator will not be responsible for any fees, damages or losses incurred as a result of a failure to secure necessary consents, permits, approvals or documentation.

By booking a Soccer Retreat that includes a minor, the booking adult accepts these Terms on behalf of the minor, including all applicable assumptions of risk and limitations of liability.

MANDATORY INSURANCE REQUIREMENTS

YOU MUST HAVE TRAVEL INSURANCE WITH A MINIMUM MEDICAL, EVACUATION AND REPATRIATION COVERAGE OF US$200,000 covering all applicable dates of travel with the Tour Operator. This insurance must cover personal injury and emergency medical expenses.

You are strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling.

You acknowledge that insurance coverage is not included in the cost of any Soccer Retreat offered by the Tour Operator and you are required to obtain separate coverage at an additional cost.

It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plan. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage.

PRICES, SURCHARGES AND TAXES

The Tour Operator will not increase the price of your Soccer Retreat after you have paid in full. Soccer Retreat prices are advertised inclusive of applicable taxes unless otherwise stated.

From time to time, the Tour Operator may offer reduced pricing on certain products or services. Reduced pricing applies only to new bookings. Bookings for which a deposit or other payment has already been received are not entitled to reduced pricing.

DETAILS REQUIRED FOR BOOKING

As a condition of booking, you must provide the information requested by the Tour Operator along with final payment.

If you fail to supply information required by the Tour Operator for travel arrangements, permits, activities or other inclusions, you will be responsible for any resulting costs, fees or losses.

The Tour Operator reserves the right to treat your booking, or the relevant component of your booking, as cancelled if required information is not provided within the required timeframe and may apply the applicable cancellation terms.

The information required by the Tour Operator will vary by Soccer Retreat and will be communicated during the booking process. The Tour Operator will not be held responsible for fees or losses resulting from errors, omissions, inaccuracies, late submission or incomplete information provided by you.

AIRFARE

Soccer Retreat prices do not include international or other airfare unless expressly stated in the description of the applicable Soccer Retreat.

TRAVEL DOCUMENTS

It is your responsibility to obtain and have in your possession all documentation and identification required for entry, departure and travel to each country or region.

This includes a valid passport and all travel documents required by relevant governmental authorities, including visas, permits, certificates and insurance policies.

You must have a passport that is valid for at least six months after the last date of travel with the Tour Operator, unless the destination’s entry requirements provide otherwise.

You accept full responsibility for obtaining all required documents, visas and permits before the start of the Soccer Retreat and are solely responsible for costs incurred as a result of missing or defective documentation.

The Tour Operator does not provide legal or immigration advice and makes no representations or warranties regarding the accuracy or completeness of information concerning visas, vaccinations, climate, clothing, baggage or special equipment.

FLEXIBILITY & UNUSED SERVICES

You acknowledge that travel to international destinations requires flexibility and that reasonable alterations to products, services or itineraries may be necessary.

Schedules, accommodations, activities, amenities and transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of the Tour Operator, including Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties.

No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to circumstances outside the control of the Tour Operator or due to your failure to participate.

THE TOUR OPERATOR IS NOT LIABLE FOR THIRD-PARTY SUPPLIERS

The Tour Operator makes arrangements with accommodation providers, activity providers, airlines, transportation companies, transfer operators, local guides, soccer facilities, coaches and other independent parties (“Third Party Suppliers”) to provide some or all components of your booking.

Third Party Suppliers may also engage local operators and subcontractors. Although the Tour Operator takes reasonable care in selecting Third Party Suppliers, the Tour Operator cannot control or supervise them and is therefore not responsible for their acts or omissions.

Services provided by Third Party Suppliers are subject to their own terms and conditions and applicable laws, regulations, tariffs, conditions of carriage, tickets and agreements.

The Tour Operator is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or independent contractors.

CHANGES

Changes Made by the Tour Operator

The Tour Operator may modify your itinerary where reasonably required in its sole discretion.

Once a Soccer Retreat has commenced, itinerary changes may be necessary because of unforeseen circumstances, operational concerns, weather, safety considerations or other circumstances affecting your health, safety, enjoyment or comfort.

Any changes are at the discretion of the Tour Operator. You acknowledge that you should have reasonable financial resources available to cover incidental expenses that may arise during travel.

The Tour Operator will not be liable for indirect or consequential losses associated with changes to a booking or itinerary.

Changes Made by You

You are responsible for ensuring that all information provided to the Tour Operator is accurate and up to date.

Changes to names or other booking details are subject to the Tour Operator’s approval, availability and applicable fees. Any additional costs incurred as a result of a change will be charged to you along with any applicable administrative fee.

No changes are permitted within 10 days of departure of the first product or service on the applicable booking.

OPTIONAL EXTRAS

“Optional Extras” refers to any activity, transportation, meal, product or service not expressly included in the Soccer Retreat itinerary or price and which does not form part of the Soccer Retreat.

Any assistance provided by the Tour Operator or its representatives in arranging or booking Optional Extras is provided solely at your request. The Tour Operator makes no warranties and disclaims liability arising from participation in Optional Extras.

You release the Tour Operator from claims arising from damages, loss of enjoyment, inconvenience or injuries related to participation in or booking of Optional Extras.

Any liability for loss, damages, death, personal injury, illness or property damage associated with Optional Extras is the responsibility of the third-party provider of that service or activity.

FORCE MAJEURE

The Tour Operator will not be liable for death, bodily injury, illness, damage, delay, financial loss or other loss or detriment to persons or property, or for failure to commence, perform or complete any obligation, where such circumstances are caused by events beyond the reasonable control of the Tour Operator or Third Party Suppliers.

Such events may include, without limitation, acts of God, war or war-like operations, mechanical breakdowns, terrorist activities or threats thereof, civil commotion, labor difficulties, government interference, political disturbance, riots, insurrection, government restrictions, fire, extreme weather, significant risks to human health, disease outbreaks or any other circumstances that make it dangerous, impractical or not viable for a Soccer Retreat to commence or continue.

IMAGES AND MARKETING

You acknowledge that during a Soccer Retreat, photographs, videos or other images may be taken by other participants, the Tour Operator or its representatives that may contain or feature you or members of your party.

You consent to the use of such photographs, videos and images and grant the Tour Operator, its contractors, subcontractors and assigns a perpetual, royalty-free, worldwide, irrevocable license to use, reproduce, edit and distribute such materials for promotional, marketing and commercial purposes in any medium now known or later developed, without further notice or compensation.

PRIVACY POLICY

The Tour Operator may collect personal information necessary to deliver the Soccer Retreat and related products and services.

The Tour Operator collects, uses and discloses information reasonably required to enable the Tour Operator and its Third Party Suppliers to provide the Soccer Retreat, products and services you have requested, in accordance with the Tour Operator’s Privacy Policy.

By submitting personal information to the Tour Operator, you acknowledge and accept the Tour Operator’s Privacy Policy.

SEVERABILITY

If any provision of these Terms is determined to be unenforceable, that provision will be interpreted only to the extent necessary to make it enforceable. The invalidity or unenforceability of any provision will not affect the validity or enforceability of the remaining provisions.

CONTRACT PARTIES & SUCCESSORS

These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, successors and assigns.

APPLICABLE LAW

The Contract and these Terms are subject to the laws of the State of Utah, USA. You agree to submit to the jurisdiction of the courts located in Salt Lake City, Utah, USA for the resolution of any dispute arising under these Terms or concerning any Soccer Retreat, product or service.

AMENDMENTS

The Tour Operator reserves the right to update or amend these Terms from time to time and will post the amended Terms on the Tour Operator’s website.

Any amendment will take effect 10 days after being posted. An up-to-date copy of these Terms may be accessed on the Tour Operator’s website and will be provided upon written request.

The Tour Operator recommends that you review the Terms prior to travel to familiarize yourself with the most current version.
